Terms and Conditions (Tutors)
Once a tutoring position has been confirmed, you are entering into a contract between you (the tutor) and The Local Teachers and the client (the student, or the student’s parent/guardian). You (the tutor) are delivering a service for The Local Teachers. The terms of contract entered by you with the client shall be in the form provided by The Local Teachers unless otherwise agreed by The Local Teachers.
Upon signature of the form by the client, you will return the form to The Local Teachers duly signed by you.
Our tutors are self-employed and are responsible for paying their own taxes. Unless employed by The Local Teachers. The following arrangements are understood and agreed by all parties:
In consideration of The Local Teachers providing you with students, you are not permitted to make private arrangements for tuition with clients introduced by The Local Teachers or with new clients introduced by The Local Teachers clients. Should you breach this obligation, you will be liable to account to The Local Teachers for all sums received by you from the client/new client without deduction and The Local Teachers shall be entitled to obtain an injunction against you to prevent further breaches. This obligation shall continue notwithstanding termination of this Agreement. Any work referred to a tutor by a client of The Local Teachers must be billed through The Local Teachers on your behalf. The Local Teachers is happy to negotiate on the rate (if needed) for new clients referred to you by our clients, but The Local Teachers must process the billing.
You and the client are responsible for finding and agreeing on a suitable environment in which tuition can take place unless specified by The Local Teachers.
The Local Teachers services have fixed fee structure with and this must not be changed without written authority of The Local Teachers. As part of the service, The Local Teachers pays a set rate agreed with you before the commencement of your contract with The Local Teachers. Please ensure that you complete your reports after each lesson immediately. If you are late completing these reports or there is incorrect information on them your payment may be delayed. You must keep your online session schedules up to date. The Local Teachers recommends that tutors keep a signed record of all lessons taught (or cancelled with less than 4hrs notice) and any ad hoc expenses agreed with client (signed by client after each lesson). We do not need to see this but if a client disputes the hours that are invoiced, we will be unlikely to be able to pay tutors if this record has not been signed. If the Local Teachers does not receive payment within a reasonable time, Tutors may obtain written permission from a Director of The Local Teachers to invoice the client directly. You must not accept any payment directly from the client without the written permission of a Director of The Local Teachers. Should you do so, all sums received by you will be immediately payable to The Local Teachers and shall be actionable through the Courts without further notice to you. You undertake to The Local Teachers that you will duly pay the tax and national insurance contributions which are due from you whether in the United Kingdom or elsewhere in relation to the payments to be made to you by The Local Teachers under this Agreement and further agree to indemnify The Local Teachers in respect of all and any income tax and national insurance contributions which may be found due from The Local Teachers on any payments made to you under this agreement together with any interest, penalties or gross-up thereon.
The Local Teachers does not reimburse any expenses between tutors and students for travel, learning materials or any other cost other than tutor’s teaching payments unless stated otherwise in writing.
Cancellation Policy:
We understand that unexpected circumstances may arise, and we
strive to maintain clarity and fairness in managing cancellations. Both clients
and tutors are expected to communicate promptly regarding any changes to
scheduled sessions.
- Notification of Absences: Both the client and the tutor are required to inform
The Local Teachers and each other in advance of any holiday commitments or
adjustments needed due to illness or inconvenience. In such cases, an
alternative date will be arranged.
- Cancellation Notice: Clients must provide a minimum of 24 hours’ notice for
the cancellation of any session. Failure to do so may result in charges.
- Tutor Cancellation Policy:
- Individual Sessions: Tutors must provide a minimum of 48 hours’
cancellation notice for sessions with single students.
- Group Sessions: For group sessions, tutors are required to give 48
hours’ notice per student. For example, if a tutor is scheduled to teach
a class of 5 students at the tuition centre from 10 am to 12 pm, they
must provide 48 hours multiplied by 5 students’ notice period for
cancellation.
- Penalties for Late Cancellation: Failure to provide adequate
cancellation notice may result in compensation. Tutors who fail to give
the required notice will be liable to compensate for the missed session(s)
by providing free teaching hours or monetary equivalent. The Local
Teachers reserves the right to assign different students for the missed
hours owed.
- Compensation for Tutors: Tutors who have not been notified of any cancellation
and turn up for the session are entitled to receive 50% of the agreed
session payment.
- Cancellation Notification Procedure: All cancellation
notifications must be made in writing via email with the subject line
“CANCELLATION NOTICE.”
We appreciate your cooperation in adhering to these policies,
which are designed to ensure a smooth and respectful learning experience for
all parties involved.
The Local Teachers do not accept any liability for any claims by the client arising out of or related to the carrying out of the tutoring by you and you agree to indemnify The Local Teachers without limit in respect of any such claims.
You undertake that you shall not at any time during this agreement, and for a period of five years after termination of this agreement, disclose to any person any confidential information concerning the business, affairs, customers, clients or suppliers of The Local Teachers, except that you may disclose The Local Teachers’ confidential information as may be required by law, court order or any governmental or regulatory authority. You shall not use The Local Teachers’ property, teaching resources and confidential information for any purpose other than to perform your obligations of delivering services for The Local Teachers under this agreement.
The Local Teachers uses tutor data for the purposes of the services that it provides. Tutors providing personal data consent to the use of that data by The Local Teachers to effecting delivery of educational courses, for billing and fee collecting purposes and to enable The Local Teachers to contact the tutor from time to time. The Local Teachers reserves the right to alter these terms and conditions. The Local Teachers will, however, notify you in writing of any changes. Unless otherwise agreed in writing by a Director of The Local Teachers, these Terms and Conditions shall prevail over any other terms of business or conditions put forward by you. No variation or alteration of these Terms and Conditions shall be valid unless approved in writing by a Director of The Local Teachers.
Acceptance of our services will be taken to represent agreement to these Terms and Conditions.
